GUIDELINES FOR ELECTION BROADCASTING IN TRANSITIONAL DEMOCRACIES is a practical and comprehensive resource book for governments, broadcasters, political parties, election monitoring and citizens groups, and all those concerned with the vital issue of free and fair elections.

Equal opportunities (sometimes referred to as “equal time”) require that a broadcaster treat all candidates for the same office in the same way. Stations must provide equal amounts of time for candidates for the same office, and otherwise treat candidates for the same office in the same way.

The book shows that the autonomy of Member States in the field of nationality law is becoming increasingly problematic for the EU, and the author takes the position that there is arguably a need for the (minimum) harmonization of European nationality laws.

The FCC’s political broadcast rules generally cover: (1) who is entitled to access to broadcast advertising time; (2) how much they pay for that time; and (3) disclosure and recordkeeping requirements.

We’ll look at each of those areas below – but we highly encourage stations with questions to contact their communications counsel. Guidelines for Political Broadcast The Broadcasting Commission reminds all broadcasters and members of the public of the requirements for political broadcasts, as set out in the Broadcasting and Radio Re-Diffusion Act and the Television and Sound Broadcasting Regulations,   The FCC’s rules (and the Communications Act) provide that “legally qualified” candidates for federal offices (e.g., President, Vice President, House and Senate) are entitled to “reasonable access” to commercial broadcast stations for the broadcast of advertising.
